The statutory mortgage for tradesmen and building contractors enables construction companies to register a pledge (mortgage) on a property to guarantee payment of an unpaid invoice. The mortgage gives the right, in the long term, to sell the property on which it is registered, in order to repay the debt. It is only possible under very specific conditions, which must be respected.

Only companies that have supplied materials and labor for a construction project can apply to register a mortgage. These include, for example, earthworks, masonry, plumbing, electrical, plastering and painting, heating, tiling, tinsmithing and roofing, carpentry, joinery companies and so on. Registration of a statutory mortgage for tradesmen and building contractors is carried out by a court, then by the Land Register.

By law, the mortgage must be registered within an extremely tight deadline of 4 months from completion of the work. It is imperative to comply with this deadline.
