Intervention in a seizure procedure

Are you being seized? Find out how to protect your rights and interests in proceedings before the debt collection office. Contact our lawyers and legal advisors for information and assistance in seizure matters.

When a seizure is carried out, the debtor is promptly summoned to the debt collection office.

The purpose of the seizure procedure is to enable the debtor's debt collection office to draw up an inventory of the debtor's assets and determine which of them are subject to seizure. Eventually, the seized assets will be sold to pay off creditors.

The debt collection office cannot seize all the debtor's assets, as the law expressly prohibits seizure of certain items such as essential personal items (furniture, clothing, personal effects, etc.) or items used in the exercise of a profession (car, tools, appliances, etc.). The debtor must also be granted a minimum subsistence allowance, which takes into account his basic needs and those of his family (housing, utilities, health insurance, etc.).

It is possible to contest a seizure if you feel it is unjustified or disproportionate, and to lodge a complaint with the supervisory authority of the debt collection office. Legalify offers assistance in the event of a seizure. Contact our lawyers for more information.
