Disputes between landlords and tenants are very common. Among the most common are those concerning the amount of rent, rent increases, termination of the lease, the condition of the rented premises or their use, or nuisances affecting the interests of one of the parties. In principle, it is advisable to try to reach a settlement in order to resolve the dispute. However, if this is not possible, it may be necessary to refer the matter to the judicial authorities. A number of cantons have set up specialized authorities to deal exclusively with tenancy law. This is the case in the cantons of Geneva and Vaud.

In most cases, proceedings are initiated by filing a request for conciliation, which leads to a hearing before a court that will attempt to bring the parties to a settlement of their dispute. If this does not work, a full procedure takes place, at the end of which a judgement is handed down.

It is important to address the relevant lease authority directly and to act early enough, in order to respect the applicable legal time limits and avoid statute of limitations. The advantage of lease proceedings is that they are generally free of charge.
