Sublease agreement

Obtain a complete and detailed sublease agreement to sublease a property in compliance with legal requirements. Determine the steps to be taken prior to subletting, in order to inform the owner of the property you are occupying or the agency in charge of managing it.

Sub-leasing, which is very common in practice, is authorized subject to a few formalities, and generally poses no problems.

The landlord's consent is required prior to the arrival of the sub-tenant. The landlord has the right to know the identity of the sub-tenant and the conditions of the sublease (duration, amount of sub-rent, other applicable conditions, etc.).

The sublease must not be abusive compared to the main lease. The sub-rent must not be too high in relation to the main rent - in principle a maximum of 20% for furnished premises, but this can vary from case to case. These aspects must be taken into account in the sublease agreement.

Finally, the landlord may refuse the sublease if it presents major inconveniences, such as illegal occupation of the premises or competition for other tenants. If all conditions are met, the landlord cannot refuse the sublease.
