In Switzerland, trademark applications must be filed with the Swiss Federal Institute of Intellectual Property (IPI). It is strongly recommended to carry out an availability analysis before applying for registration, to check that a similar trademark is not already protected. A minimum fee of CHF 550.- is charged by the IPI. Protection can be applied for in different classes. There are currently 45 such classes, for example pharmaceutical products (class 5), scientific or research apparatus (class 9) or management services (class 35).
A trademark can be protected in Switzerland only, or internationally, with the option of choosing the countries in which protection is desired. The greater the number of countries in which protection is sought, the more expensive the registration, since each country levies a registration fee.
Trademark protection lasts for 10 years, with the possibility of renewal for 10 years at a time, indefinitely. Protection begins as soon as the application for registration is filed. This provides almost immediate protection for the owner, which is particularly important if the registration procedure is delayed or prolonged, for example because of an objection in Switzerland or abroad.
