Employer-employee disputes

Disputes frequently arise between an employer and an employee, in particular over the quality of the employee's performance, disagreements over working conditions or salary issues. While such disputes are sometimes settled amicably, they can also end up in court, often when the employment agreement is terminated. In such cases, legal advice is recommended, as the rules applicable in employment law can be strict, and certain procedural rules differ from those in other areas of the law.

It is first advisable to try to reach a settlement, insofar as this is possible. If this does not work, the matter should generally be referred to the judicial authorities. Several cantons, including Geneva, Vaud and Valais, have set up a specialized labor law authority, known as the “tribunal des prud'hommes” or “tribunal du travail”.

Most legal actions begin with a request for conciliation, which leads to a hearing before a court that will try to bring the parties to an agreement. If conciliation is unsuccessful, a trial will have to be held. It is advisable to be represented by a professional attorney before the judicial authorities.
